1. General terms
These terms and conditions (“Agreement”) govern your use of the Ink Career website located at www.inkcareer.com (“Website”). The Website is owned and operated by Inspirit Tattoo AS (“Ink Career,” “we,” or “us”). By accessing or using the Website, you agree to be bound by this Agreement. If you do not agree to any of these terms, we kindly ask you to refrain from using the Website.
1.1. Ink Career
Ink Career™ is an online platform owned and operated by Inspirit Tattoo AS.
Inspirit Tattoo AS is a Norwegian registered company with organization number NO925372897MVA, address: Pedersgata 47, 4013 Stavanger, Norway. The organization number is searchable in the Brønnøysund Register Centre.
The Brønnøysund Register Centre is a public registry in Norway that contains information about Norwegian companies, organizations, and individuals. You can search for the organization number 925 372 897 in the Brønnøysund Register Centre on their website www.brreg.no.
1.2. Right of Use
Ink Career grants the user a limited, non-exclusive right to use the Ink Career website in accordance with these terms and conditions. All use of the Ink Career website is at the user’s own risk and responsibility.
The user is responsible for complying with all applicable laws, rules, and regulations in connection with the use of the Ink Career website. This includes, but is not limited to, rules on discrimination, equal opportunity, and the right to seek employment or advertise positions without discrimination based on race, gender, religion, nationality, age, or other protected status.
The user agrees not to use the Ink Career website to promote or publish content that is unlawful, threatening, defamatory, offensive, discriminatory, violent, or otherwise unacceptable. The user understands that Ink Career reserves the right to remove or disable content that violates these guidelines.
Ink Career makes no warranties or representations regarding the accuracy, reliability, or completeness of the information available on the Ink Career website. The user acknowledges that any decision to apply for jobs or enter into employment based on information from the Ink Career website is the user’s own responsibility.
The user understands that Ink Career is not a party to any employment contract or agreement between job seekers and employers. Any agreement, communication, or transaction between the user and a third party on the Ink Career website is solely between the user and the respective third party.
As a user of the Ink Career website, you are responsible for your own use and actions on the website. You agree to use the website in accordance with applicable laws and regulations, as well as these terms and conditions.
You commit to refrain from engaging in the following actions on the Ink Career website:
- Posting or sharing false, misleading, or defamatory information.
- Uploading or distributing content that is illegal, offensive, threatening, hateful, discriminatory, or otherwise objectionable.
- Using the website to spam, send unsolicited advertisements, or unwanted messages to other users.
- Misusing or attempting to gain unauthorized access to others’ accounts or personal information.
- Employing harmful software, viruses, or other technologies that may disrupt or harm the website or its users.
You are responsible for the accuracy and timeliness of the information you provide on the website, including your profile, CV, and applications. You agree not to publish or provide false or misleading information.
If you discover or suspect any misuse or unauthorized use of your account or breaches of security on the website, you must immediately inform Ink Career for appropriate action.
Ink Career cannot be held liable for any loss, damage, or costs arising from the user’s use of the Ink Career website or from the user’s interaction with third parties on the website. All use of the website is at your own responsibility and risk.
Ink Career reserves the right to suspend or terminate the user’s access to the Ink Career website if any violations of these terms and conditions are discovered or if Ink Career deems it necessary to protect the integrity and security of the website and its users.
1.3. Intellectual Property Rights
Ink Career owns all intellectual property rights to the content on the website, including but not limited to text, images, graphics, logos, videos, and software. These intellectual property rights are protected by copyright, trademark law, and other laws and regulations governing intellectual property.
The user is granted a limited, non-exclusive right to use the content on the website for personal and non-commercial purposes in accordance with these terms and conditions. Any other use, including but not limited to reproduction, distribution, modification, or public display of the content, is prohibited without written permission from Ink Career.
Any trademarks, logos, or names displayed on the website belong to their respective owners and are protected by trademark laws. No rights to such trademarks, logos, or names are transferred to the user through the use of the website.
The user agrees not to copy, modify, distribute, or otherwise use the content on the website in a manner that infringes upon the intellectual property rights of Ink Career or third parties.
If the user believes that the content on the website infringes upon their intellectual property rights or the rights of third parties, they may submit a written complaint to Ink Career with necessary documentation. Ink Career will review the complaint and take appropriate action in accordance with applicable laws and regulations.
Any unauthorized use of the content on the website may result in civil and/or criminal liability under applicable laws and regulations governing intellectual property.
1.4. Termination of User Accounts
Ink Career reserves the right to close or terminate a user account if there is a violation of these terms and conditions or if it is necessary to maintain the integrity and security of the website and its users.
In the event of a violation of the terms, Ink Career may, at its own discretion, suspend or terminate a user account without prior notice. This may include, but is not limited to, the following situations:
- Illegal or inappropriate use of the website.
- Abuse or attempts to harm the website or its users.
- Unauthorized access to or use of others’ accounts or personal information.
- Other actions or omissions deemed as a threat to the website or its users.
Users who wish to close their account on Ink Career can do so by contacting customer support or following the instructions for account deletion on the website.
Please note that closing or terminating a user account will result in the automatic deletion of any active ads or services associated with the account, and this action is irreversible.
Closing or terminating a user account does not entitle the user to any refunds for any active advertising services.
All communication on the platform is done at your own risk. This includes, but is not limited to, job applications, communication, or chats with other users or third parties. Ink Career disclaims any liability for such communication.
2. Advertising rules
These rules (“advertising rules”) govern all posting of advertisements on Ink Career’s websites (inkcareer.com) and mobile applications (“Ink Career channels”), whether the ad is posted by an individual or a business entity. By posting an ad, the party posting the ad (“advertiser”) accepts the applicable ad rules in effect at the time.
When posting a job or a resume, you are required to select an advertising package before proceeding with the ad submission.
Furthermore, Ink Career reserves the right to stop or remove ads, text, or links that, upon overall assessment, are deemed to diminish the user experience of the ad or Ink Career’s channels, or are considered a security risk.
Ink Career will make every effort to provide prior notice of ad removal; however, in some cases, removal may occur without prior warning.
In certain instances, we may temporarily halt ads pending the advertiser’s submission of documentation to demonstrate compliance with the advertising rules. Such documentation may include proof of ownership or authenticity.
We strive to ensure that the ads on the Ink Career platform comply with our guidelines and provide a positive user experience. We encourage advertisers to collaborate with us in maintaining the quality and integrity of our channels.
2.2. False information
Ads containing false information or deliberately misleading details will be removed and may result in a permanet ban from the Ink Career platform.
2.3. User-generated content
With user-generated content, it refers to all content created and/or posted by you as a user of Ink Career’s channels, such as images, videos, music, ad texts, other texts, graphic representations, logos, or similar materials (“User-generated content”).
You guarantee that you have the necessary rights to the user-generated content, either as the original creator or with permission from the original creator to use the user-generated content on Ink Career’s channels. This means that you guarantee that the user-generated content does not contain any copyrighted material that you are not authorized to use.
Furthermore, you guarantee that you have ensured that individuals identifiable in the user-generated content (e.g., in a photo, video, or by name) are aware that it will be used on Ink Career’s channels and that they have accepted this. We encourage caution when using images of children in ads, as we do not want children to be identifiable based on images or other information.
In the event of claims of rights infringement regarding user-generated content, Ink Career may require a court decision confirming the infringement before the ad is halted.
By posting user-generated content on Ink Career’s channels, such as placing an ad, you grant Ink Career an unlimited right to freely use the user-generated content and other information generated through interactions with Ink Career (“Information”), including processing, formatting, storing, or copying it and making it available to the public, regardless of the media channel. You also grant Ink Career the right to transfer these rights to potential partners. Ink Career may also use the user-generated content for marketing purposes. Ink Career retains these rights even after an ad is deleted.
Your posted job will be visible across various platforms within Ink Career’s channels, including the website Inkcareer.com and relevant sections of Ink Career’s mobile applications. It will be accessible to potential job seekers and other individuals interested in the tattoo industry who visit these platforms.
Please note that in order to apply for a job, users are required to be registered and have a resume on Ink Career. This ensures that only registered users can apply for the advertised job.
2.5. Liability and responsibilities
As an advertiser on Ink Career, you are fully responsible for the content of your ad, ensuring that the information provided is accurate and complies with applicable laws, regulations, and third-party rights.
Ink Career disclaims any liability for the content of the ads and the outcome of the ads. You are solely responsible for the content and accuracy of your ads. Ink Career does not assume responsibility for false, misleading, or inaccurate ads. Additionally, Ink Career is not liable for any losses or damages that may arise from your actions, communications, or interactions with other users on the website.
Ink Career shall not be portrayed, perceived, or regarded as the advertiser’s representative, broker, agent, or similar. The advertiser shall indemnify Ink Career against any claims related to the advertiser’s ads.
2.6. Non-discrimination policy
Ads containing discriminatory or offensive content based on race, gender, religion, age, sexual orientation, or disability will not be accepted.
2.7. Licensing and certification
Ads for positions requiring specific licenses or certifications must clearly indicate the requirements that applicants must fulfill.
2.8. Right of cancellation
When purchasing services online, you usually have a right of withdrawal within 14 days. However, you must waive this right when advertising on Ink Career’s channels. This is because advertising services are delivered immediately. By using these services, you agree that the right of withdrawal ceases when the services are deemed delivered. The services are considered delivered immediately after the ad is published. The same rules apply to additional services you purchase in connection with advertising, such as modifications, renewals, or purchasing additional visibility for an ad.
Ink Career’s service is considered delivered when the ad is published in Ink Career’s channels.
2.10. Ad Duration
Your ad will be visible until you deactivate or delete it. However, please note that the ad will no longer be visible if there are outstanding payments on the subscription or if the subscription has expired.
All prices are stated excluding VAT.
No VAT (MVA) is applied to advertising services purchased by individuals or businesses located outside of Norway.
We reserve the right to adjust the prices of advertising services and features due to changes in prices from our partners, suppliers, or currency fluctuations. Any price changes that occur after the time of order will not apply retroactively to current advertisements.
The buyer is responsible for any taxes and fees levied in their home country in connection with the purchase of advertising services.
The advertisement package is an ongoing subscription and will automatically renew until canceled. The billing cycle is specified in the chosen advertisement package and will be indicated during checkout.
You have the flexibility to cancel the subscription at any time, with the cancellation taking effect from the next subscription period. However, please ensure to cancel at least 1 day before the start of the new subscription period to avoid any further charges. Please note that a registered cancellation does not alter the advertiser’s obligation to pay for the remaining portion of the current subscription period, but it will prevent the start of a new subscription period. Any payments already made for the current subscription period(s) will not be refunded.
When purchasing advertising services or other paid services on the Ink Career website, payment shall be made directly with a credit -/or debit card at the checkout. Ink Career utilizes Stripe as the payment processor to handle the payment transaction. By completing the payment, you agree to be bound by Stripe’s terms and conditions for use and privacy.
*Subscriptions are automatically charged from the credit card registred to the subscription.
The resume you submit on Ink Career will be visible to potential employers and recruiters who are searching for candidates on the platform. It will be accessible within the Ink Career website and may be viewed by employers who have access to the resume database or are actively searching for candidates with your qualifications and experience.
3. Other terms
Ink Career takes website security seriously and implements various measures to protect users’ information and ensure a safe and reliable experience on the website. We take reasonable precautions to safeguard against unauthorized access, loss, misuse, or alteration of users’ personal data.
Personal Information: Ink Career collects and processes personal information in accordance with applicable privacy laws and regulations. We employ technical and organizational measures to protect personal data against unauthorized access, accidental loss, alteration, or destruction. We restrict access to personal information to authorized employees and subcontractors who need such information to perform specific tasks on behalf of Ink Career.
Encryption: Ink Career utilizes encryption technology to secure the transmission of sensitive information between the user and the website. This includes the use of SSL (Secure Socket Layer) or similar technologies to maintain the confidentiality and integrity of data during transmission.
User Behavior: Users are encouraged to take responsibility for their own security when using the Ink Career website. This includes protecting their password, avoiding sharing login credentials with others, and being aware of potential threats such as phishing or malware. Ink Career will never ask users to provide sensitive personal information via email or other insecure communication channels.
Monitoring and Vulnerability Testing: Ink Career continuously monitors the website to detect and address any security threats or vulnerabilities. We regularly conduct vulnerability testing and update security measures in accordance with best practices to ensure that the website is protected against known threats and attacks.
Despite our security measures, it is important to note that no system or transmission method can guarantee 100% security. Therefore, Ink Career cannot provide an absolute guarantee of the security of information transmitted or stored on the website. Users are encouraged to take precautions and implement their own security measures, such as keeping software and operating systems up to date, using reliable security software, and being cautious about sharing personal information online.
In case of any suspected security breaches or unauthorized use of the website, users are encouraged to report it to Ink Career so that necessary actions can be taken to protect the user’s data and rights.
The user and Ink Career agree that the platform, advertising service and its delivery cannot be guaranteed to be error-free, and that Ink Career continuously works on improving the advertising services.
Ink Career does not provide any warranties that the advertising services will meet the user’s requirements or function properly with the user’s chosen equipment, systems, settings, configurations, customizations, plugins, or integrations not performed or controlled by Ink Career. Ink Career also does not guarantee uninterrupted delivery of the advertising services over the internet. Ink Career cannot be held responsible for the internet, internet service providers, or the user’s internet connection.
If there are errors or deficiencies in the advertising services, Ink Career will attempt to correct confirmed errors or deficiencies at its own expense. “Confirmed errors or deficiencies” refer to errors or deficiencies that can be reproduced by Ink Career and/or confirmed through Ink Career’s support channels, and occur during the advertising period. In some cases, Ink Career may choose to replace the advertising service or functionality instead of rectifying the error.
If a confirmed error or deficiency is of significant scope and Ink Career does not rectify or replace the advertising service within a reasonable time, the user may choose to terminate the right to use the affected advertising service. In such cases, the user is entitled to a proportional refund for payments made for the remaining period of the affected advertising service, starting from the month after the error or deficiency was confirmed by Ink Career.
Unless expressly stated otherwise, the user does not have the right to raise any other or additional claims against Ink Career.
3.4. Ink Career's Responsibility
Ink Career disclaims any liability for direct or indirect financial loss arising from the use of the Ink Career website or any services provided through the website. This includes, but is not limited to, loss of income, loss of profit, loss of data, or loss of business opportunities. Ink Career does not provide any warranties regarding the accuracy, reliability, or completeness of the information offered on the website and does not accept any responsibility for any errors or omissions in the information.
Furthermore, Ink Career is not liable for any damages or losses resulting from the user’s interactions on the website or interactions with third parties, including employers, advertisers, or other users of the website. Ink Career encourages users to exercise caution and make their own assessment of the information and services offered on the website. While Ink Career takes necessary precautions to ensure secure transmission of information between the user and the services, the user acknowledges that the internet is an open system and Ink Career cannot guarantee that third parties will not intercept or modify data.
3.5. Limitation of Liability
Ink Career shall not be liable for any form of direct or indirect damages, losses, costs, or liabilities arising from the use of the Ink Career website or any services provided through the website. This includes, but is not limited to, economic loss, loss of income, loss of profits, loss of data, loss of business opportunities, or claims from third parties.
To the extent permitted by applicable law, Ink Career shall not be liable for any errors, inaccuracies, or omissions in the information provided on the website. Ink Career also disclaims liability for any damages or losses arising from the user’s interactions on the website or interactions with third parties, including employers, advertisers, or other users of the website.
Ink Career shall not be liable for any technical issues, errors, interruptions, or delays that occur due to causes beyond Ink Career’s control, including but not limited to network problems, computer failures, or actions of third parties.
The user acknowledges and agrees that Ink Career provides no warranties, either express or implied, regarding the operation, availability, accuracy, or reliability of the website.
To the extent permitted by applicable law, Ink Career’s aggregate liability for any claims, losses, or damages arising from the use of the website or services, regardless of the cause or legal basis, shall be limited to the amount directly paid by the user to Ink Career for the use of the services during the past twelve (12) months.
This limitation of liability applies to the extent permitted by applicable law and applies regardless of whether Ink Career has been advised of the possibility of such claims, losses, or damages.
Ink Career reserves the right to engage subcontractors or third-party providers to perform certain services or tasks on behalf of Ink Career, including the processing of Personal Data and/or usage data.
Ink Career will always enter into a data processing agreement with subcontractors to fulfill the obligations outlined in this agreement. If the subcontractors are located outside the EU, the parties agree that Ink Career is responsible for ensuring a valid legal basis for the transfer of personal data outside the EU on behalf of the customer. Ink Career will only use approved transfer mechanisms.
Ink Career will take measures to ensure that any subcontractors comply with strict privacy and data security standards. However, Ink Career cannot be held liable for any privacy or security breaches resulting from the actions or omissions of such subcontractors unless negligence or gross negligence on the part of Ink Career can be proven.
Ink Career will inform the customer of any significant changes in subcontractors that may affect the processing of the customer’s data. The customer has the right to express concerns or objections to such changes within a reasonable timeframe.
3.7. Legislation and Dispute Resolution
These terms and conditions, as well as any use of the Ink Career website, shall be governed by and construed in accordance with Norwegian law. Any dispute or disagreement arising in connection with these terms or the use of the website shall be attempted to be resolved amicably between the parties.
If an amicable resolution cannot be reached, the dispute shall be settled by the ordinary courts of Norway in accordance with Norwegian law. The parties hereby submit to the personal jurisdiction of such courts and waive any objection to the propriety of such forum.
Any claims or lawsuits arising from the use of the Ink Career website or in connection with these terms must be brought within one (1) year after the claim or cause of action arose, otherwise they shall be barred.
If any provision of these terms and conditions is deemed invalid, illegal, or unenforceable by a competent court, such provision shall be deleted or limited to the extent permitted by law, while the remaining provisions shall continue to be fully valid and binding upon the parties.
